THIS IS YOUR OMEGA SIGHT LIMITED-WARRANTY FOR YOUR NEW OMEGA SIGHT-RANGEFINDER-VIDEO CAMERA, ALL-IN-ONE. YOU MUST PRESENT YOUR PURCHASE RECEIPT THAT DISPLAYS THE PURCHASE DATE TO OBTAIN WARRANTY SERVICE.
OMEGA SIGHT ONE YEAR LIMITED WARRANTY
OMEGA’s One-Year Limited Warranty applies to the components of this OMEGA SIGHT, which components are warranted by OMEGA SIGHT’S parent company, Lil Bow Peep, LLC (hereinafter, OMEGA), and are to be free from defects in material and workmanship for a period of ONE (1) YEAR from the date of purchase by the original consumer or from an OMEGA SIGHT authorized dealer/reseller.
During the one-year time period, as stated above, if a component of this sight is found to be defective in material or workmanship, OMEGA will at its option, either repair or replace this SIGHT with a new product comprising of the same model, without charge; cash or credit refunds are not permitted under this or any Warranty of Goods of OMEGA. Except to the extent restricted or prohibited by law, this warranty is subject to the following conditions, limitations and exclusions:
1. This warranty extends to the original consumer purchaser only and is not assignable or transferable, unless otherwise required by law.
2. This warranty shall not apply to any product which has been subjected to misuse, abuse, abnormal use, negligence, alteration, accident, power surge, or has had its serial number altered or removed.
3. This warranty does not apply to any defects or damage directly or indirectly caused by or resulting from the use of unauthorized replacement parts and/or service performed by unauthorized personnel.
4. This warranty does not apply to any batteries or power supply.
5. This warranty is valid only with authentic SIGHT’S sold new by OMEGA and purchased from OMEGA or its authorized dealers/resellers.
Unless restricted or prohibited by applicable law, in returning this OMEGA product for repair or replacement, the original consumer purchaser must first email for a Return Authorization (RA) Number by emailing info@omegasights.com. OMEGA will not be responsible for any loss or damage incurred in connection with the return or delivery of any OMEGA product and will not accept any return that does not have an assigned RA Number. The original consumer purchaser must prepay all postage, shipping transportation, insurance and delivery costs, and the OMEGA product must be delivered in either its original carton or a similar package affording an equal degree of protection. All returns must be shipped at the purchaser’s expense to Omega Sights, 305 Lake Road, Unit B, Medina, OH, 44256 with the RA number clearly displayed on the outside of the shipping carton, included inside the package needs to bear a copy of the purchaser’s sales receipt, depicting source and date of purchase, the serial number, specific reason and defect for return, and information of the purchaser submitting warranty request, including consumer’s name, address, email address, and phone.
SUBJECT TO APPLICABLE LAW TO THE CONTRARY,THIS WARRANTY IS MADE EXPRESSLY IN LIEU OF ALL OTHER REPRESENTATIONS, WARRANTIES AND CONDITIONS, EXPRESS, IMPLIED, STATUTORY OR COLLATERAL, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT, QUALITY OR DURABILITY, AND ALL OTHER OBLIGATIONS ON THE PART OF OMEGA PROVIDED, HOWEVER, THAT IF THE DISCLAIMER OF IMPLIED WARRANTIES AND CONDITIONS IS INEFFECTIVE UNDER APPLICABLE LAW, THE DURATION OF ANY IMPLIED WARRANTIES ARISING BY OPERATION OF LAW SHALL BE LIMITED TO ONE (1) YEAR FROM THE DATE OF PURCHASE OR SUCH LONGER PERIOD AS MAY BE REQUIRED BY APPLICABLE LAW. SUBJECT TO APPLICABLE LAW TO THE CONTRARY, OMEGA HEREBY DISCLAIMS ANY AND ALL LIABILITY FOR DIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, INDIRECT, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH ANY BREACH OF THIS WARRANTY OR ANY OTHER CLAIM WITH RESPECT TO THIS SIGHT, INCLUDING BUT NOT LIMITED TO, CLAIMS OF NEGLIGENCE, STRICT LIABILITY IN TORT OR BREACH OF CONTRACT. SOME STATES/PROVINCES/TERRITORIES DO NOT ALLOW (A) LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR (B) THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY APPLIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND UNLESS RESTRICTED OR PROHIBITED BY LAW. WHERE ANY TERM OF THIS WARRANTY IS RESTRICTED OR PROHIBITED BY APPLICABLE LAW, SUCH TERM SHALL BE NULL AND VOID, BUT THE REMAINDER OF THIS WARRANTY SHALL REMAIN IN EFFECT. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE/ PROVINCE/ TERRITORY TO STATE/ PROVINCE/ TERRITORY.
